網(wǎng)絡(luò)拍賣的法律問題分析
摘 要
在信息時(shí)代的今天，商業(yè)秘密已經(jīng)成為各企業(yè)的核心財(cái)富。但目前，中國大部分企業(yè)對商業(yè)秘密的保護(hù)還停留在起步階段，很多漏洞給權(quán)利人造成巨大損失。商業(yè)秘密的賠償制度是權(quán)利人得到實(shí)質(zhì)救濟(jì)的關(guān)鍵，能否有效進(jìn)行賠償與保護(hù)，成為制約企業(yè)發(fā)展的1大障礙。文章通過論述什么是商業(yè)秘密，涵蓋范圍；如何保護(hù)商業(yè)秘密尤其是在企業(yè)與員工在雇傭關(guān)系中如何防止商業(yè)秘密的流失，從在企業(yè)內(nèi)部的第1環(huán)節(jié)中保護(hù)商業(yè)秘密以及侵犯商業(yè)秘密后的保護(hù)和賠償；中國商業(yè)秘密的立法現(xiàn)狀極其缺陷，以期完善商業(yè)秘密的相關(guān)立法，使之更具有實(shí)物操作性，達(dá)到維護(hù)公平競爭的目的。

Abstract
In information time today, the business secret already became various enterprises the core wealth. But at present, the Chinese majority of enterprises also pause to the business secret protection in the start stage, very many loopholes create the heavy loss for the right person. The business secret compensation system is the right person obtains the substantive relief the key, whether effectively carries on the compensation and the protection, becomes a big barrier which the restriction enterprise develops. The article through elaborates any is the business secret, covers the scope；How protects the business secret in particular in hires in the relations in the enterprise and the staff how to prevent the business secret draining, from protects the business secret as well as the infringement business secret protection and the compensation after in the enterprise interior first link；The China business secret legislation present situation extremely flaw, by the time consummation business secret correlation legislation, enable it to have the material object to be operational, achieves the maintenance fair competition the goal.
