證人證言在民事訴訟中證明作用研究
摘 要
證人證言是指證人在訴訟過程中就其感知的案件情況向司法機關所作的陳述。證人證言除了具備證據的相關性合法性真實性之外出于證人證言是人的主觀意識和客觀事物相結合的產物，具有與其他民事訴訟證據不同的1些特征。證人證言在其作用、表現和采信上都具有其特殊性保障證人證言取得的合法性、保障證人出庭作證、保障證人的權利、完善質證環節人保障認證準確，都有利于證人證言在民事訴訟中證明作用的充分發揮。

Abstract
The testimony of a witness is the statement given by the witness of his perceptions on the case in the course of proceedings.In addition to the same traits of relevance, legitimacy and authenticity both possessed by the testimony and the evidence, the testimony of witness also has some different features from other civil actions for it came out from the combination of subjective sense of human and objective existence. The testimony of witness has its particularity on its function, performance and credibility. So,guaranteeing the legality of the testimony,guaranteeing the witness’s appearance in the court,guaranteeing the authenicity of the statement will all contribute to proving thir role into a full play in a civil action.
