論土地承包經(jīng)營權出租
摘 要
土地承包經(jīng)營權出租是指土地承包經(jīng)營權人將土地承包經(jīng)營權出租給他人（包括單位和個人）經(jīng)營，他人支付土地租金的行為。現(xiàn)階段，出租作為土地承包經(jīng)營權流轉的重要方式，在我國普遍存在并且出現(xiàn)了大量的問題。而理論界對土地承包經(jīng)營權能否出租，出租與轉包是否為同1法律概念分歧不斷，土地承包經(jīng)營權出租的立法規(guī)定也較為混亂，進而使得土地承包經(jīng)營權出租實踐中的問題得不到有效解決。根據(jù)當前存在的問題，立法機關在以后的立法過程中，1定要強化土地承包經(jīng)營權的物權性質(zhì)，厘清土地承包經(jīng)營權出租法律關系主體，明確出租雙方權利與義務，制訂詳盡的出租操作規(guī)程，以到達農(nóng)民承包地自愿、規(guī)范、有序、依法出租的目的。

ABSTRACT

to strengthen the land contracting operating right the real right nature, the thousandth of a Yuan clear land contracting operating right hiring legal relationship main body, will be clear about hires the bilateral right and the duty, will draw up the exhaustive h-
iring working instruction. Arrives the farmer to contract the standard voluntarily, to h-
ave the goal which the foreword, legally hires.
