論執(zhí)行回轉(zhuǎn)制度
摘 要
執(zhí)行回轉(zhuǎn)制度屬于強(qiáng)制執(zhí)行制度，是救濟(jì)制度中的1種方法，是1種判決書(shū)下達(dá)后的救濟(jì)方法。執(zhí)行回轉(zhuǎn)仍然是1種執(zhí)行程序，也就是說(shuō)執(zhí)行機(jī)關(guān)行使強(qiáng)制執(zhí)行權(quán)的1種表現(xiàn)，執(zhí)行權(quán)的行使如果沒(méi)有確定性和權(quán)威性，顯然會(huì)進(jìn)1步導(dǎo)致執(zhí)行難問(wèn)題的惡化。我國(guó)目前在強(qiáng)制執(zhí)行制度方面最大的問(wèn)題就是“執(zhí)行難”問(wèn)題。執(zhí)行回轉(zhuǎn)制度是對(duì)當(dāng)事人權(quán)利的救濟(jì)。本文具體闡述了執(zhí)行回轉(zhuǎn)制度的具體內(nèi)容、執(zhí)行回轉(zhuǎn)與既判力和我國(guó)現(xiàn)存的執(zhí)行難問(wèn)題與執(zhí)行回轉(zhuǎn)的關(guān)系。

ABSTRACT
Recovery of execution is a part of Enforcement System, its not only a method in the Remedy System, but also a remedy method after the judgement s release .Nevertheless, recovery of execution can be counted as a Enforcement process as well, which is a expression of the law-related governments to finish the Administrative Execution. If the fulfillment of execution doesnt have its own certainty and authority. Obviously it will leads to a worse condition in the "Hard Enforcement". The biggest problem regarding Enforcement System in our country is "Hard Enforcement". Recovery of execution is a relief for the right of related party. This article explains the details of recovery of execution, recovery of execution and Adjudged Force, the existing problem of "Hard Enforcement" in our country, and its relationship with recovery of execution.
