論沈家本的法制思想
摘要
沈家本作為近代中國(guó)著名法學(xué)家、法制改革家和法律思想家，是清末法律改革的重要人物之1，他順應(yīng)社會(huì)發(fā)展的歷史潮流，激流勇進(jìn)，推波助瀾，在近代的法制改革中發(fā)揮了極為重要的作用。所以，被法史界譽(yù)為“法學(xué)泰斗”、“媒介中西法律文化的冰人”、“中國(guó)傳統(tǒng)封建法制掘墓人”、“中國(guó)法制近現(xiàn)代化奠基人”。沈家本主持清末法律改革，會(huì)通中西，融合中西文化；重視人權(quán)，主張法律面前人人平等；1法立而天下共守，他主張3權(quán)分立；他奠定了中國(guó)近代法制的基礎(chǔ)，基本上完成了中國(guó)古代法制向近現(xiàn)代法制的轉(zhuǎn)型，促進(jìn)了中國(guó)法律現(xiàn)代化進(jìn)程；同時(shí)，亦是外來(lái)法律資源本土化的過程。
